STUDY VISIT ON INTELLECTUAL PROPERTY MANAGEMENT IN CANADA

During the course of working with Canadian agencies, the delegation raised various questions about related contents and were thoroughly answered by the Canadian side. These will be useful experiences for IP Viet Nam and relevant agencies of Viet Nam in researching and applying to the practice of intellectual property management.

Within the framework of the Non-project "Supporting the implementation of the Comprehensive and Progressive Agreement for Trans-Pacific Partnership in the field of intellectual property in 2023" approved in Decision No. 2143/QD-SHTT dated September 22 /2023 of the Minister of Science and Technology, from November 27 to December 1, 2023, the Intellectual Property Office of Viet Nam (IP Viet Nam) has organized a study trip to learn experiences in protecting sound marks and enforcing intellectual property rights in Canada. The participants includes officials from functional units of the Ministry of Science and Technology, leader of the Department of Management and Supervision of Tax, Fees and Charges Policy under the Ministry of Finance and officials of IP Viet Nam headed by Deputy Director General Le Huy Anh.
 
Within the study program, the delegation visited and worked with the Canadian Intellectual Property Office (CIPO). CIPO Chief Executive Officer, Mr. Konstantinos Georgaras and leaders of CIPO's relevant units received and shared  experiences with the delegation about CIPO's general activities and initiatives to help Canada become a global innovation center, Canada's intellectual property strategy, CIPO’s operational strategy for the period 2023-2028, training services, intellectual property awareness raising, planning, financial mechanism and CIPO’s administration. CEO of CIPO, Mr. Georgaras expressed his pleasure and appreciation for the delegation's business trip. He emphasized the results of the bilateral meeting with the Director General of IP Viet Nam on the sidelines of the World Intellectual Property Organization (WIPO) General Assemblies in July 2023, and expressed hope that the two Offices will soon sign a bilateral cooperation agreement in the near future.

Regarding the protection of sound marks, the delegates had fruitful discussions with experts from CIPO and trademark lawyers from several major Canadian law firms about the process and procedures for registering non-traditional trademarks in general and sound marks in particular, especially the obligation to prove the use of the trademark before the time of filing the application.
 
Apart from the above mentioned meetings, the delegation also had a working session with the Canadian Department of Innovation, Science and Economic Development (ISED) - the line Department of CIPO to learn about initiatives to promote innovation and intellectual property strategy of Canada. The delegation was introduced to the functions and tasks of ISED in building a legal corridor on intellectual property, implementing initiatives and activities under the intellectual property strategy, providing legal advice, training, patent landscape and patent pool for women-led small and medium-sized enterprises, indigenous community startups as well as establishing a database of transfer of intellectual property rights and cooperation model between the Government and institutes/schools.

Another important content of the mission is  to study the Canada’s enforcement of intellectual property rights, which the delegation focused on when working with the Canada Border Services Agency (CBSA). Enforcing more than 100 acts and related legal regulations, with 14,000 employees, CBSA manages and performs intellectual property border control functions for import/export activities at 1,200 points across Canada and at 39 international locations based on the assistance requests of the right holders and the ex officio action of the customs.

Also within the framework of the study tour, the delegation visited and worked with the Embassy of Viet Nam in Canada to inform the Embassy of the objectives of the business trip. Ambassador Extraordinary and Plenipotentiary of Viet Nam to Canada Pham Vinh Quang warmly received the delegation and expressed his satisfaction with the results of cooperation in the field of intellectual property between Viet Nam and Canada, shown through the study visit organized by IP Viet Nam. The Ambassador affirmed that the Embassy of Viet Nam in Canada is willing to support and bridge IP Viet Nam with Canadian partners to further promote intellectual property cooperation between the two countries.

These will be useful experiences for IP Viet Nam and relevant agencies of Viet Nam in researching and applying to the practice of intellectual property management. Deputy Director General Le Huy Anh, on behalf of the delegation, thanked the donor of the Non-project - the Global Affairs Canada, the non-project management and implementation organization - Cowater, and other Canadian stakeholders and experts for having provided technical support to Viet Nam in the field of intellectual property. After a week, the delegation successfully concluded the study mission on intellectual property in Canada that contributing to achieving the goals set out in the Non-project "Supporting the implementation of the Comprehensive and Progressive Agreement for Trans-Pacific Partnership in the field of intellectual property in 2023".
